By accessing or using the Cramigo platform (the “Service”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Cramigo is an online supplemental study platform for professional certification exams. The Service provides AI-powered adaptive quizzes, flashcards, multimodal study content, spaced repetition scheduling, gamified learning features, and related tools designed to help users prepare for professional licensure and certification examinations.

3. No Professional Advice Disclaimer

IMPORTANT: Please read this section carefully.

Cramigo is a supplemental study tool only. The Service is not a replacement for official exam body guidelines, handbooks, study materials, or professional requirements. Cramigo does not provide certification, licensure, professional, legal, or exam-readiness advice of any kind.

Users should always consult the official governing body for their specific certification or licensure examination for authoritative guidance on exam content, eligibility requirements, and professional standards.

No representation is made that use of the Service will result in passing any examination. Exam outcomes depend on many factors beyond the scope of any study platform, including but not limited to individual preparation, prior knowledge, test-taking conditions, and the specific requirements of each exam program.

4. AI-Generated Content Disclaimer

A significant portion of the study content available on the Service is generated using artificial intelligence technologies and subsequently reviewed by subject matter experts. While we strive for accuracy and quality in all content, you acknowledge that:

• AI-generated content may contain errors, inaccuracies, or omissions despite our review processes.
• Content should be cross-referenced with official source materials, exam body publications, and authoritative references.
• Cramigo is not liable for any inaccuracies in study content or for any decisions made based on such content.
• Content is provided for educational and study purposes only and should not be treated as definitive or authoritative.

5. Account Registration & Security

To use certain features of the Service, you must register for an account. When registering, you agree to:

• Be at least 18 years of age or the age of majority in your jurisdiction.
• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and accept responsibility for all activities that occur under your account.
• Use only one account per person. Account sharing is prohibited.
• Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion and without prior notice.

6. Subscription & Billing

Access to the Service requires a paid subscription. By subscribing, you agree to the following:

• Subscriptions are billed on a recurring basis (monthly or annually) through our third-party payment processor, Stripe.
• Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date.
• Cancellation takes effect at the end of the current billing period. You will retain access to the Service until the end of your paid period.
• No partial refunds are provided for unused time within a billing period.
• We reserve the right to change subscription prices with at least 30 days' prior notice. Continued use of the Service after a price change constitutes acceptance of the new price.
• All fees are stated and charged in United States Dollars (USD).

7. Acceptable Use

You agree not to use the Service to:

• Share your account credentials with others or allow multiple people to use a single account.
• Scrape, crawl, or use automated means to access or collect data from the Service.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Reproduce, redistribute, sell, or commercially exploit any content from the Service.
• Use content from the Service to build or contribute to a competing product or service.
• Engage in harassment, abuse, or any conduct that is harmful to other users or to the operation of the Service.
• Use the Service for any illegal purpose or in violation of any applicable law or regulation.

8. Intellectual Property

All content, features, functionality, branding, graphics, software, and other materials available through the Service are owned by Cramigo LLC or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial study purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Service without prior written permission from Cramigo LLC.

9. User-Generated Content

You may submit feedback, testimonials, content flag reports, and other materials (“User Content”) through the Service. With respect to User Content:

• You retain ownership of your feedback and other User Content.
• By submitting a testimonial with explicit consent, you grant Cramigo LLC a perpetual, worldwide, royalty-free, non-exclusive license to use, reproduce, and display that testimonial for marketing and promotional purposes.
• We will only use testimonials where the user has provided explicit consent.
• You represent that any User Content you submit does not violate the rights of any third party.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of your data as described in the Privacy Policy.

11. Accessibility

Cramigo is committed to making the Service accessible to all users, including individuals with disabilities. We design and develop the Service in accordance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards and continuously work to improve the accessibility of our platform. 12. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. Cramigo LLC does not warrant that (a) the Service will function uninterrupted, securely, or be available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service, including any study content, will be accurate, reliable, or complete.

13. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Cramigo LLC, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; or (d) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

In no event shall Cramigo LLC's total liability to you for all claims exceed the amount you paid to Cramigo LLC in the twelve (12) months preceding the event giving rise to the claim.

14. Indemnification

You agree to defend, indemnify, and hold harmless Cramigo LLC, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any provision of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property, privacy, or proprietary right; or (d) any claim that your User Content caused damage to a third party.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide at least 30 days' notice via email to the address associated with your account or by posting a prominent notice on the Service. Your continued use of the Service after such notice constitutes acceptance of the modified Terms. If you do not agree to the updated Terms, you must stop using the Service before the changes take effect.

16. Termination

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. You may cancel your subscription at any time through the billing settings in your account.

Upon termination: (a) your license to use the Service ends immediately; (b) you will not receive a refund for any unused portion of your current billing period unless required by applicable law; and (c) your data will be retained and handled in accordance with our Privacy Policy.

17. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration administered in Denver, Colorado. You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.

BY AGREEING TO THESE TERMS, YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

18. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Cramigo LLC regarding your use of the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties. No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term.
